As a result of the ruling, and because Alderfer was almost done serving his time for his guilty plea, Corso decided to vacate the entire sentence, Taxis said. The lifetime probation requirement was replaced with a requirement for lifetime counseling for convicted sex offenders.A convicted sex offender from Perkasie will soon be released from state prison following a Montgomery County judge's ruling that the man's sentence under Megan's Law is unconstitutional. Alderfer, 26, is an inmate at Cresson State Prison in Cambria County. An order issued Tuesday by Montgomery County President Judge Gerald Corso states Alderfer's sentence is illegal and he should be freed. That condition is also being challenged as unconstitutional, Taxis said."We may have 90-year-olds who are still required to go to counseling," she said."It just doesn't make sense."Those who violate Megan's Law by failing to register their address can still be sentenced to prison time but not to lifetime probation.

As of Wednesday afternoon, Alderfer was still listed as an inmate at the prison."This is a real benefit for [Alderfer] because his sentence was clearly excessive and unconstitutional," Taxis said.Alderfer was also found to be a sexually violent predator and was ordered to register his address with police. Police in Souderton, where Alderfer used to live, learned he had moved to a woman's home in Perkasie without notifying his probation supervisor. He was then charged with failing to register as a sex offender under Megan's Law."The district attorney and judge both agreed it was the right thing to do to release him."In 2000, Alderfer was charged with having sexual contact with numerous teenage girls while living in Telford, according to court documents.

He pleaded guilty to involuntary deviate sexual intercourse and was sentenced to a year in prison and six years of probation.Mary Mac Neil Killinger, a prosecutor with the appellate division of the Montgomery County district attorney's office, could not be reached for comment Wednesday.
